Poland: Suspension of state sales of agricultural land extended until 2026

The suspension of the sale of the property of the Agricultural Property Stock of the Treasury was extended until April 30, 2026.

The Act passed by the Sejm of the Republic of Poland on March 17, 2021 and signed by the President of the Republic of Poland on April 21, 2021, the act amending the act on suspending the sale of real estate from the Agricultural Property Stock of the Treasury and amending certain acts will enter into force on April 30, 2021.

The basic form of distribution of agricultural property from the Agricultural Property Stock of the State Treasury is lease.

It is very popular among individual farmers, because it creates the possibility of a convenient way of using land and buildings and does not require the involvement of significant financial resources by tenants - as is the case with the permanent acquisition of real estate.

Suspension of sales does not apply to property held for non-agricultural purposes, or the so-called. investment real estate and real estate with an area of up to 2 ha. For the sale of such real estate it is not and will not be required to obtain the consent of the Minister of Agriculture and Rural Development by the General Director of the National Center for Agricultural Support.

The Act also provides for :

• clear regulation of the issue of withholding the sale of shares in joint ownership of real estate, so as to avoid possible doubts in this regard (clear indication that the suspension of sale also includes shares in joint ownership),

• clarification that in the application submitted to the Minister of Agriculture and Rural Development for consent to the sale of real estate , their parts or shares in joint ownership, included in the Agricultural Property Stock of the State Treasury , the General Director of the National Center for Agricultural Support, in particular, indicates what socio-economic considerations justify the sale of real estate, their parts or shares in joint ownership of real estate; thus, the basic shape of the current regulation has been maintained, according to which the Minister of Agriculture and Rural Development, at the request of the General Director of the National Agricultural Support Center, may consent to the sale of real estate or part of it, if it is justified by socio-economic reasons.
