Fermented milk drinks producers from Russia and Belarus to reconcile disputed matter

On December 1, the Department for Antitrust Regulation of the Eurasian Economic Commission (EEC) involving representatives of the competition agencies of the Eurasian Economic Union (EAEU) countries sent a proposal to eliminate violations of the general rules of competition in the transboundary market of fermented milk drinks.

Earlier, the Federal Antimonopoly Service (FAS) of Russia had submitted to the Commission an application of Wimm Bill Dann (Russian Federation) on possible violations of the general rules of competition by Limited Liability Company Nesvizh Baby Food Factory (Republic of Belarus).

In its application, the Russian manufacturer has stated that a fermented milk drink under the brand of "IMMUNO Lakto" manufactured by Nesvizh Baby Food Factory, LLC, the packaging design and name of which are similar to the fermented milk drink under the brand of "Imunele" produced by Wimm Bill Dann, JSC is being sold in retail chains since 2020.

According to the applicant, this misinforms the consumers about the product manufacturer and can be qualified as signs of unfair competition on the part of the Belarusian company.

The companies are competitors in the market of fermented milk drinks and have been registered in the territories of different Union Member States which determines the jurisdiction of the EAEU supranational body to settle this dispute.

Following review of the materials and working consultations conducted by the Commission’s Antitrust Unit, the disputers — manufacturers of fermented milk drinks "IMMUNO Lakto" and "Imunele" were proposed to redesign the product packaging within the prescribed time limits and notify the EEC thereof.

Both economic entities and representatives of the EAEU States’ competition agencies have agreed with the measures contained in the proposal.
